I have my I 140 and I 485 (Aug 07 filer) for a future employment from a small company with EB2 as software engineer. I 140 still pending and got an RFE. I got the EAD. In a month am going to finish 180 days.
Currently, I work for Fortune's Best software company as sr. software QA engineer. My company wants to go ahead filing for my GC.
As this current company being a best american software company and I can stay for any longer, I wish to go ahead with filing for a fresh GC. However, I was wondering how I could use the benefits of the priority date from the previous 485 filing mentioned above. my company attorney suggests that am eligible for EB3 where as my 485 already filed is under EB2.
What would be the implication if my current employers files for EB3 and my previous I 485 filing is under EB2. What are the options that are available for leveraging the benefits of my previous filing or using EAD?
What is the best course of action.

Hi all,
Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....
I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...
So my questions are:
a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
c) Should I file for H1B Amendment also

It can be done in Swift 3D. First, create a box. Then create a pyramid shape and place it above the box. Color the pyramid red and the box a white or brown. You now have a house. I am US citizen since March 2009. Husband just received an interview notice for August 11 after having filed all required documents and application for I-485 adjustmnent of status. Along with other documents, we submitted a xerox copy of his I-94 which he overstayed. Unfortunately, he lost the original. My concern is, the interview notice states he is to bring the original I-94, which he no longer has. He can prove however the date of his last entry to the US, as he still has a stamp in his passport with admission date, a sticker on his passport cover for baggage and I can probably dig up his boarding pass. Again - we also made a xerox copy of both sides of I-94 when we still had it. What do I do? Should I get a duplicate? Or is the xerox enough for the interview? I would hate his application to be denied because of this. Please let me know if you had a similar experience or any advice on what I should do.

Valid EAD along with SSN is used for work. As you are waiting for the corrected EAD, you cannot work I guess.

Hi Tracey,
Looks like you're off to a good start. The white flower is slightly out of focus. I'm not familiar with the Easyshare but I'm guessing you might have been inside of its minimum focal distance.
The first baby photo also seems to be a little on the soft side but I can't tell if it's due to camera shake or just from resizing the image.
