Hi Immigration Voice Team,
I would like to know your advice,
My details are
- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010
I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.
As of now
- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.

guys who have already filed 485.
Do u know if its possible to schedule an earlier fingerprinting date? can we just walk to a ASC with our appointment letter and get our fingerprinting done?

my wife went to mumbai embassy. after intw they said they need some more info in their systems before issuing the visa. It was h1 renewing. But they didn't keep the passport. Told to submit the passport after they sent email or call you. They did sent the email to submit the passport within 2 days.

:confused: I came in US on 15 Oct 2006. The company A who had filed my H1 was not able to arrange a job for me till 5-Dec-06 & they were not paying me as well. So I contacted company B & they arranged a project for me & I started working for them & I am being paid by company B from 11-Dec-06 & company B started my H1 transfer without paystub. Now in this case my H1 transfer will approve or not.

Our Application was also received by M.Salcedo at TSC on August 2nd. We got all our receipts on October 1st. When I checked the status online for 765, the status showed - 'Card Production Ordered'

You EAD or AP may be approved at anytime while your 485 is pending, it is a derivative benefit of the pending 485 petition. If the 140 is rejected then everything collapses like a stack of dominos.

My company applied for my 140 (Substitute) in Premium processing (before it was stopped) and I recieved an RFE for ability to pay. Company took sometime & responded with Tax returns.
Online status says, response to RFE recieved and the processing resumed. Since mine is a PP, I epxected the result in 15 days...but its more than a month...
So I contacted my employer & he says USCIS asked for "Audited Financial statement". But online status did not change. (Still says, we recieved your response & case processing is resumed).
Is it possible that USCIS just asks for more information in reponse to RFE but still does not update the status?? What I don't understand is - normally USCIS Deny the app if they are not OK with my employer's initial response is n't it? how are they coming back & asking for more & more information??
I am confused!! Please throw light if you know more details...

Hi Guys:
I'm in a process of transfering my H1B to a new employer. I've already hired a lawyer and paid him his fee. The lawyer spoke to my employer and everything was going fine. Now, my new employer tells me that his company "froze hiring" untill further notice !?!
I'm wondering
1. Is my employer lying and why?
2. Can I somehow make my employer pay me back the money I already paid to the lawyer?

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

I am in 7th year of H1B which expires in Dec 2011. I-140 is approved. Applied for H1B extension in Oct2010 (after 6 yrs completed) based on approved I-140 but got extension for only 1 yr till 2011 (got client letter for 1 yr only) . Can i transfer my H1B to new Employer based on my approved I-140 from my current Employer? If so, can i get 3 yr extension with the new Employer or will the new H1B be valid only till 2011?
